Several states have regulated online gambling. However, there are several other jurisdictions in the world that do not permit this activity. For example, in India, gambling is illegal.<\/p>\n

This legislation was criticized by the Justice Department for being a step in the wrong direction. Despite the failure of the bill, legislation has been introduced to the House of Representatives.<\/p>\n
One of the key issues has been the enforcement of federal gambling laws. Some have argued that the Commerce Clause trumps the free speech guarantee of the First Amendment. Other have argued that due process should apply when financial transactions occur in the United States. These arguments have not yielded significant results.<\/p>\n
